SPONSOR: Hewlett Packard Enterprise Company 3000 Hanover Street, Palo Alto, California, United States (the “Sponsor”).

 

ADMINISTRATOR: RAVEN5 Ltd., B9-461 North Service Rd., W., Oakville, ON, L6M 2V5, Canada (the “Administrator”).

 

CONTEST ENTRY PERIOD: 25 Years of ProLiant Innovation Contest (the “Contest”) begins at 12:00:01 AM Eastern Time (“ET”) on Thursday September 13, 2018 and ends at 11:59:59 PM ET on Friday October 26, 2018 (the “Contest Period”).

 

ELIGIBILITY: The Contest is open only to legal residents of the United States (including Puerto Rico), Canada (excluding Quebec), Switzerland, United Kingdom, Ireland, South Africa, Singapore, Australia, New Zealand, Philippines, India (excluding Tamil Nadu), Romania, Netherlands, Luxembourg, Mexico, Brazil, Germany, Russia, France, Italy, Spain, Japan and Belgium who have reached legal age of majority in their jurisdiction of residence at the time of entry; have a valid Facebook, Twitter, or Instagram account in good standing; and work for the company that purchased the ProLiant server prior to the start of the Contest Period for which an entry is being made (“Participant”).

 

Employees, representatives, or agents of Sponsor, its parent companies and their respective subsidiaries, affiliates, advertising and promotion agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, the “Contest Parties”), and the immediate family members of, and/or those living in the same household of each, are not eligible to enter. Persons employed in the public sector and Hewlett Packard Enterprise channel partners are not eligible to enter.

 

Contest is subject to all applicable federal, state, provincial, municipal, territorial, and local laws and regulations and these official rules (“Official Rules”) and by entering, all participants agree that they have read these Official Rules, the Facebook, Instagram and/or Twitter terms and policies (collectively, the “Social Platforms Terms and Policies”), and agree to abide by and to be bound by the terms and conditions of the Official Rules, Social Platforms Terms and Policies and the decisions of Sponsor, which shall be final and binding in all respects. False and/or deceptive Entries or acts shall render participants ineligible. If it is found that a person who does not meet the eligibility criteria set forth in these Official Rules has submitted an entry, that entry will be deemed ineligible. Sponsor reserves the right to verify eligibility requirements. Void where prohibited by law.

 

HOW TO ENTER: Visit www.Proliant25.com for details on submitting your entry. To enter the Contest, take a photo of the front bezel of your company’s ProLiant server and write a caption describing how the server best fits the criteria of one (1) of the four (4) categories as outlined below:

 

Category #1: ProLiant Apps: Describe how the server runs various unique or innovative applications. For example, applications that leverage Artificial Intelligence, Big Data, Mobility, the Cloud, or the Internet of Things.

 

Category #2: ProLiant Remote: Describe where the server is located, and the remoteness of the location of where the server runs. For example, how far is the server located from a city, is it running in a location difficult to travel to?

 

Category #3: ProLiant Secure: Describe the security features utilized by the server. The more security features, the better. For example, what security controls are in place? What security certifications are being utilized? Are there any security scan tools or security information and event management tools? What kind of encryption is used? Is there any network security?

 

Category #4: ProLiant Resilient: Describe how the server has survived extreme operating conditions or calamity. For example, has the server been exposed to any extreme operating conditions such as extreme temperatures, or vibrations? Has the server survived a disaster including but not limited to exposure to fire, water or other catastrophe? Has the server continued functioning through such disaster or has the server shutdown gracefully and/or re-started without data loss?

 

Post your photo and caption including the Contest hashtag: #contest; and one (1) of four (4) category hashtags: #HPEProLiantapps; #HPEProLiantremote; #HPEProLiantsecure or #HPEProLiantresilient to Facebook, Instagram, or Twitter to earn one (1) entry into the Contest (the “Entry”). Limit of one (1) Entry per category per company during the Contest Period. Limit of four (4) total Entries per person during the Contest Period. To enter in multiple categories, a new Entry must be made for each category.

 

Facebook Entry: To enter the Contest on Facebook, post the photo and description including hashtags directly to @HPEServers Facebook page to earn one (1) Entry into the Contest.

 

Twitter Entry: To enter the Contest on Twitter, follow @HPE_Servers and tweet the photo and description including hashtags to earn one (1) Entry into the Contest.

 

Instagram Entry: To enter the Contest on Instagram, follow @HPE and post the photo and description including hashtags from a public account to earn one (1) Entry into the Contest.

 

For the Entry to be valid, it must include one (1) photo with a caption of 280 characters or less and must contain the Contest hashtags: #contest; and one (1) of four (4) category hashtags: #HPEProLiantapps; #HPEProLiantremote; #HPEProLiantsecure or #HPEProLiantresilient. Any incomplete or copied/non-unique Entries will be considered ineligible.

 

IT IS YOUR SOLE RESPONSIBILITY TO ENSURE THAT YOU DO NOT DISCLOSE ANY CONFIDENTIAL OR PROPRIETARY INFORMATION OF YOUR COMPANY IN THE COURSE OF PARTICIPATING IN THIS CONTEST.

 

ENTRY REQUIREMENTS AND RESTRICTIONS: Submitted photos must clearly feature a ProLiant server with the front bezel showing and include a description of how the server best fits the criteria for one of the four categories. Submissions must be original, in good taste and comply with the respective social media platform’s terms of service, available at https://www.facebook.com, www.twitter.com and www.instagram.com respectively.

 

The ProLiant server featured in a submission must be owned by the Entrant’s business entity prior to the start of the Contest Period. Entrants must secure permission from their company’s Vice President and IT Director prior to taking the photo and submitting an Entry. Entries cannot be used for personal gains, to solicit business, or to suggest endorsement by Sponsor and its affiliates.

 

To protect personal privacy, Entries which contain or reference third party personal information, and/or photos featuring distinguishable features of a person, will not be eligible for Contest Entry. Silhouetted figures, or shots of people at angles that don’t clearly show an identifiable face, will be accepted. Any photos not in line with the theme or deemed inappropriate or non-complaint with these Official Rules and the applicable Social Platform Terms and Policies for any reason will not be eligible for the Contest. Photographs that have been digitally edited with software, cropped, enhanced, colour and sharpness adjusted will be accepted. Sponsor will make the final determination, in its sole and absolute discretion, as to whether any Entry is eligible.

 

Entries containing any profanity or lewd references will be disqualified at the sole discretion and judgment of Sponsor. Without limiting the generality of the foregoing, any obscene, offensive, sexual or otherwise inappropriate Entry including without limitation those referencing or depicting violence, nudity or explicit activity, or which are not in the spirit of the Contest or do not meet Sponsor’s standards for any reason, as solely determined by Sponsor, will be deemed ineligible and Entries will be disqualified if they include any of the following: Crude, obscene, offensive, vulgar, sexually-inappropriate or offensive language and/or symbols; Derogatory characterizations of any ethnic, racial, sexual or religious groups; Content that endorses, condones or discusses any illegal, inappropriate or risky activity, behaviour or conduct; Personal information of individuals, including without limitation, names and addresses (physical or e-mail); Conduct or other activities in violation of these Official Rules; Commercial messages, comparisons or solicitations for products or services; Any identifiable third party products and/or trade-marks; any third party copyrighted content or portions thereof; celebrity endorsement or influence; URLs or links to any websites; and any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by Sponsor and/or the Contest judging panel in their sole discretion.

 

By entering the Contest and submitting an Entry, each entrant: (i) without limiting the applicable Social Platform Terms and Policies, as applicable, grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her Entry (and each component thereof), in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her Entry (and each component thereof) in favor of the Sponsor (and anyone authorized by the Sponsor to use such Entry); and (iii) agrees to release and hold harmless the Sponsor and all of the other Released Parties (as defined below) from and against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever.

 

PRIZES/APPROXIMATE RETAIL VALUE (“ARV”)/ODDS:

Grand Prize: One (1) Grand Prize is available to be won. Grand Prize consists of: (a) one (1) trip for one (1) person to HPE Discover in Madrid, Spain; and (b) one (1) HPE DL380 Gen10 4114 1P 32G 8SFF Server.

 

The ARV of the Grand Prize: $10,499.00 USD based on departure from Houston, Texas. Actual retail value may vary depending on the point of departure.

 

Grand Prize Details: Grand prize winner will receive a trip for one (1) person to HPE Discover 2018 in Madrid, Spain which includes round-trip economy airfare for one (1) adult from the major airport located nearest to the winner’s residence to Adolfo Suárez Madrid-Barajas Airport in Madrid, Spain; four (4) nights’ accommodation at a Hewlett Packard Enterprise approved hotel selected at Sponsor’s sole discretion in one (1) standard room with single occupancy; and one (1) all access HPE Discover Pass. Sponsor reserves the right to provide alternative methods of transportation or another hotel than those provided above. The Trip may not be used towards any type of frequent flyer mileage, or other reward points accumulation program. Winner must travel in November 2018 on dates as specified by Sponsor in its sole discretion. Grand Prize may not be combined with any other coupon, certificates, discount, bonus, upgrade, or promotional offers/tickets. Void if altered. Booking and travel dates must fall into the range as specified or Prize will be forfeited, and Released Parties will have no further obligation to the Winner.

 

Winner will be responsible for all expenses not specifically included in the Prize (as described above), including transportation between winner’s residence and the nearest major airport, meals, alcohol, in-room entertainment, car rentals, insurance, medical/health expenses, gratuities, excess baggage fees, communication charges and any other personal expenses and incidentals. Winner is responsible for ensuring that all necessary travel documents (including a valid passport where applicable) are obtained for him/her prior to ticketing. Winner must comply with all hotel check-in requirements, including the presentation of a major credit card. The Sponsor will not be responsible for any cancellations, delays, diversions or substitution or any act or omission whatsoever by the air carriers, hotels, venue operators, transportation companies, or any other persons providing any Grand Prize-related services or accommodations. No refund or compensation will be made in the event of the cancellation or delay of any flight. The Sponsor will not be liable for any loss or damage to baggage.

 

The HPE DL380 Gen10 4114 1P 32G 8SFF Server will be awarded to the winner’s business entity.

 

First Prizes: Four (4) First Prizes are available to be won. First Prize is one (1) soft sided cooler.

 

The ARV of each First Prize is: $299.99 USD. The total ARV of all First Prizes is $1,199.96 USD.

 

The total ARV of all prizes available to be won: $11,698.96 USD.

 

Odds of winning will depend upon the total number of eligible Entries received. All applicable taxes and duties on the prize are the sole responsibility of the winner. By accepting the prize, the prize winner agrees to release the Released Parties from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by the prize or resulting from acceptance, possession, or use/misuse of prize awarded. The prize is not exchangeable or transferable. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute the prize with another prize of equal or greater value, in Sponsor’s sole discretion.

 

PRIZE CONDITIONS: All expenses related to the acceptance or use of the prize is the sole responsibility of prize winner. Sponsor reserves the right to use any and all information related to the Contests for promotional, marketing and any other purpose, including online announcements unless prohibited by law. The winner will be required to execute and return an Affidavit of Eligibility & Liability / Publicity Release as a condition of acceptance of the Prize.
Prize winners are responsible for all federal, state, local and income taxes associated with winning prize. Grand Prize winner may be required to furnish its TIN for the sole purpose of preparation of any tax forms as required by law.

 

Grand Prize Winner must receive authorization to accept the HPE DL380 Gen10 4114 1P 32G 8SFF Server on behalf of their business entity. Such authorization must include the business entity’s agreement to be bound by all of the terms and conditions of these Official Rules. Further, the Sponsor will not intervene in any decisions made by an entity pursuant to a policy of that entity with respect to the awarding of prizes by suppliers

 

JUDGING TO DETERMINE TWENTY (20) FINALISTS: At the conclusion of the Contest Period, all eligible Entries received will be judged by a panel of judges appointed by Sponsor (the “Judges”). Judges will score each eligible Entry based on the following criteria (“Judging Criteria”):

Relevance to theme – 30 points
Innovativeness – 30 points
Originality – 20 points
Creativity – 20 points

Total points available to be earned is: 100.

 

Based on the Judges scores, the five (5) highest earning Entries from each of the four (4) Categories will be deemed the Potential Finalists (“Finalists”) subject to verification of eligibility and compliance with these Official Rules. In the event of a tie that would result in more than five (5) Finalists in a particular category, all such Entries that are tied in the applicable Category will be re-judged by an additional Judge selected by Sponsor, who, using the Judging Criteria, will break the tie. The Judges’ decisions are final and binding in all matters relating to this Contest.

 

FINALIST VERIFICATION: The twenty (20) eligible Finalists will be contacted by a designated representative of the Sponsor via direct message to the Facebook, Twitter, or Instagram account used at time of Entry on or about October 27, 2018 to verify eligibility and compliance with these Official Rules. The designated representative will make a minimum of two (2) attempts to contact the eligible Finalists within forty-eight (48) hours of the selection. Each eligible Finalist will be required to verify their Entry, verify eligibility, and provide the serial number of the ProLiant server associated with the Entry within seventy-two (72) hours of notification.

 

Eligible Finalists will be required to verify Entry details including but not limited to: server location, server security settings, server applications, or proof of damage as part of the verification process. Eligible Finalists will also be required to verify that they are not employed in the public sector and that they have received authorization to participate in the Contest from the IT Director and Vice President of their company to participate in the Contest including providing names of the IT Director and Vice President of their company.

 

If a Finalist cannot be contacted within forty-eight (48) hours of the selection, if there is a return of any notification as undeliverable, or if the eligible Finalist cannot complete all verifications required by the Sponsor in accordance with these Official Rules, then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified. If a Finalist fails to verify the Entry, eligibility, or fail to provide a valid ProLiant server serial number within seventy-two (72) hours of notification; then he/she will be disqualified.

 

WINNER SELECTION:

Grand Prize: The highest earning Entry among the verified Finalists will be deemed the potential Grand Prize Winner. In the event of a tie, the tied Entries will be re-judged by an additional Judge selected by Sponsor, who, using the Judging Criteria, will break the tie. The Judges’ decisions are final and binding in all matters relating to this Contest.

 

First Prizes: The Entries that earn the highest Judges score among the Verified Finalists for each of the four (4) Categories will be deemed the potential First Prize Winners. When the Entrant that earned the highest Judges score in a specific Category is selected as the potential Grand Prize Winner, the Entry that earned the next highest Judges score for that Category will be deemed the potential First Prize winner.

 

WINNER NOTIFICATION:

All prize winners are considered “Potential” pending submission of required documents and verification of eligibility and compliance with these Official Rules.

 

The Potential prize winners will be notified by a designated representative of the Sponsor via direct message to the Facebook, Twitter, or Instagram account used at time of Entry on or about November 2, 2018. The designated representative will make a minimum of three (3) attempts to contact the eligible winners within forty-eight (48) hours of the selection.

 

If a Potential prize winner cannot be contacted within forty-eight (48) hours of the selection, if there is a return of any notification as undeliverable, or if the eligible winner cannot complete all verifications required by the Sponsor in accordance with these Official Rules then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit any all rights to the applicable prize) and the Sponsor reserves the right, in its sole and absolute discretion to select an alternate eligible entrant for the applicable prize from the remaining eligible Finalist Entries submitted and received in accordance with these Official Rules.

 

No one is a winner unless and until the Sponsor officially confirms him/her as a winner in accordance with these Official Rules.

 

Before being declared a Confirmed Prize Winner, the Potential winners will be required to sign and return, within seventy-two (72) hours of notification, an Affidavit of Eligibility & Liability and a Publicity Release (except where prohibited by law). The Potential Grand Prize Winner may be required to sign and return a W-9 form, requiring the eligible winner to furnish his/her TIN for the sole purpose of tax reporting, where required by law. The Potential Grand Prize Winner will be required to provide a signed agreement from the IT Director and Vice President of their company stating acceptance of the HPE DL380 Gen10 4114 1P 32G 8SFF Server. Noncompliance will result in disqualification. The prize packages will be awarded within approximately 45 days after the winners are confirmed.

 

The prizes are not assignable, nor transferable. No substitution is permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. No cash in lieu of the prize and no exchange or substitution of the prize, except at the sole discretion of the Sponsor. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility.

 

Winners are responsible for all federal, state, local and income taxes associated with winning prize. Except where prohibited by law, Entry and acceptance of a prize constitutes permission to use winner’s name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

 

GENERAL: Participants agree to these Official Rules and the decisions of the Sponsor and release the Sponsor, its parent companies and their respective subsidiaries, affiliates, and advertising and promotion agencies involved in the administration, development, fulfillment and execution of this Contest (the “Released Parties”), from all claims and liability relating to their participation in the Contest, and the acceptance and use/misuse of the prize offered. Winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Contest or use/misuse or redemption of the prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize.

 

The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible Entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of Entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive Entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or (iii) any injury or damage to participant’s or any other person’s computer or other device related to or resulting from participating in the Contest. By participating in the Contest, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Contest. Failure to comply with these Official Rules may result in disqualification from the Contest. Sponsor reserves the right to: (i) permanently disqualify from any Contest it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw a method of Entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Contest). If for any reason this Contest is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the Entry process, and to cancel, terminate, modify or suspend the Contest, at which time, Sponsor will conduct the Judging process from among all eligible Entries received at the time of the Contest termination.

 

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

 

DISPUTES: Except where prohibited, Participant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Province of Ontario, Canada. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Province of Ontario without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.

 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
